1.  Terms of Service

About Us

Somewhen Wines Pty Ltd (ABN 12 345 678 901, SA Liquor Licence #57654321) sells wine online at somewhenwines.com.au (“Site”).  By browsing or ordering you accept these Terms.

Minimum Age & Responsible Service

Wine is only supplied to persons 18 years and over.  By creating an account or completing checkout you warrant you are at least 18.  We reserve the right to request proof of age on delivery; couriers may refuse delivery if suitable ID is not provided. 

Personal-Use Only

All products are sold for domestic enjoyment, not resale.  Buying on behalf of a minor or for re-sale breaches these Terms and relevant liquor laws.

Pricing & Availability

Prices are in Australian dollars and include GST unless stated otherwise.  We work hard to keep vintage details, stock and pricing current but errors may occur; we may cancel an order and refund you if stock is unavailable. 

Payment Security

Shopify Payments and PayPal encrypt card data to PCI-DSS standards.  We never store your full card details.

Liability & Australian Consumer Law

Nothing in these Terms limits your statutory rights under the Australian Consumer Law (ACL).  To the extent permitted by law, our liability is limited to replacing the goods, supplying equivalent goods, or refunding the purchase price, at our election. 

Copyright & Trademarks

All Site content—including the Somewhen name, “Wine for any time” tagline and bottle imagery—is our property.  Don’t use it without written consent.

User Content & Behaviour

Keep it civil: no defamatory, abusive, or unlawful material.  We may moderate or remove content that breaches these Terms.

Changes

Terms may change occasionally; continue use of the Site after updates equals acceptance of the new Terms.  Check back whenever you order. 

Governing Law

These Terms are governed by the laws of South Australia and the Commonwealth of Australia.  Any disputes are subject to the non-exclusive jurisdiction of SA courts.

 

2.  Returns & Quality Guarantee

Our Promise

Every Somewhen bottle leaves the winery in peak condition, ready to capture that moment.  If it arrives damaged or doesn’t taste right, we’ll make it right—no fuss.

Damaged or Incorrect Stock
  • Email wine@somewhen.com.au within 14 days of delivery.

  • Attach a photo of the damage or describe the issue.

  • We’ll send a prepaid return label or arrange collection, then offer replacement, credit, or full refund—your choice.

365-Day Taste Guarantee

If a bottle shows a genuine fault (cork taint, oxidation, refermentation) within 365 days of purchase, reseal it (at least three-quarters full) and contact us.  We’ll replace the bottle or refund you. 

When We May Decline a Refund
  • Heat damage caused after delivery (e.g., wine left on a verandah in 40 °C).

  • Bottles more than 365 days old unless faulty.

  • Less than 75 % of contents remaining.

Your ACL rights still apply.  Nothing here limits those statutory protections.

 

3.  Privacy Policy

We respect the moment and your privacy.  This policy explains how we collect, use and protect personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). 

What We Collect
  • Contact details (name, address, email, phone).

  • Age confirmation (18 +).

  • Purchase history, preferences, and Site analytics.

  • Payment details (processed by secure third-party gateway—never stored in full).

Why We Collect It
  • To pick, pack and deliver your order.

  • To verify age and prevent fraud.

  • To improve our wines, service and Site experience.

  • With your consent, to send you offers, new-release alerts and “somewhen stories”.

Disclosure

We share data only with:

  • Delivery partners (Australia Post Wine Service, Fastway) for shipping.

  • Secure payment providers.

  • Cloud platforms that host our Shopify store and marketing emails.

    All partners must comply with the APPs or equivalent safeguards.  We do not sell your data.

Overseas Transfers

Certain IT providers may store data in the USA, EU or UK.  Where that occurs we take reasonable steps to ensure comparable privacy protections (APP 8). 

Access & Correction

Email wine@somewhen.com.au to access or correct your data.  We’ll respond within 30 days (APP 12 & 13).

Direct Marketing & Opt-Out

You can unsubscribe any time via the link in our emails or by contacting us (APP 7).

Security

We employ SSL certificates, encryption in transit and at rest, role-based access controls, and regular penetration testing.  If a notifiable data breach occurs we’ll follow OAIC procedures.

Cookies

We use essential Shopify cookies and analytics cookies (Google Analytics) to improve the Site.  You can disable cookies in your browser, but some features may break.

 

4.  Shipping & Delivery

Where We Ship

We currently ship Australia-wide via Australia Post’s specialised Wine Service.  Sorry, no international orders just yet—but we’re working on it.

Shipping costs $20 per wine pack regardless of quantity.
Free shipping on orders $300 or more in one transaction.

Delivery windows are estimates; extreme heat, vintage release surges, or carrier delays may add time. 

Heat-Hold Policy

If forecast temps are above 35 °C in either Adelaide or the destination, we’ll automatically hold dispatch until conditions ease, safeguarding wine quality. 

Authority to Leave (ATL)

By default parcels require a signature and age-ID.  You can request ATL at checkout, but couriers will still ask for ID if anyone appears under 25 or if alcohol can be accessed by minors.  If no one 18 + is present, the parcel will go to the nearest Post Office for collection. 

Tracking

You’ll receive a tracking link once your order is manifested.  Refreshments and anticipation encouraged.

Delivery Issues

  • Damaged cartons: refuse delivery or photograph damage and contact us within 48 hours.

  • Missing in transit: let us know; we’ll chase the carrier and, if lost, resend or refund.

  • Vintage roll: if the advertised vintage sells through during peak periods we’ll contact you before shipping substitutes.

Alcohol Restrictions

Shipping complies with Australia Post’s Wine Parcel Guide and all state liquor licensing laws.  We cannot deliver to “dry zones” or communities where alcohol is restricted.
